1. Acceptance of Terms

By downloading, installing, or using KlipCam, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, please do not use the app and delete it from your device.

2. App License and Usage

MILIVON grants you a limited, non-exclusive, non-transferable license to use KlipCam for personal, non-commercial purposes only. Under this license, you may not:

  • Modify, copy, or create derivative works of the app
  • Use the app for any commercial purpose without written permission
  • Attempt to decompile, reverse engineer, or extract source code
  • Remove any copyright, trademark, or proprietary notices
  • Use the app to violate any applicable laws or regulations

3. Privacy-First Design

KlipCam is designed with privacy as a core principle. We do not require user accounts for basic usage, and your images are stored locally on your device. When you use AI generation features, images are temporarily processed by third-party AI services and automatically deleted after processing.

4. AI Content Generation Terms

KlipCam uses artificial intelligence to generate and modify images and videos, including AI Influencers and Avatars. By using our AI features, you understand and agree that:

  • AI-Generated Content: All output is created using artificial intelligence and should be treated as such.
  • Content Accuracy: AI-generated content may not accurately represent real people, places, or objects.
  • No Guarantees: AI results may vary and are not guaranteed to meet your expectations.
  • Processing Limitations: Processing may take time and could occasionally fail due to technical issues.
  • Service Availability: We do not guarantee the availability or uptime of AI services.
  • Model Updates: AI models may be updated, which could affect output quality or style.

5. AI Content Usage and Restrictions

When using AI generation features, you agree to the following restrictions:

  • Prohibited Content: Do not attempt to generate illegal, harmful, pornographic, or violent content.
  • No Deepfakes: Do not use the app to create misleading representations intended to deceive others.
  • Age Restrictions: Do not upload images of anyone under 18 years of age.
  • Consent Required: Only upload images of people who have consented to AI processing.
  • Intellectual Property: Do not generate content that infringes on others' intellectual property rights.
  • Commercial Use: AI-generated content for commercial use requires separate licensing unless otherwise stated in your subscription plan.
  • Misrepresentation: Do not present AI-generated content as real photographs or authentic representations.

6. Content Ownership and AI Rights

Regarding AI-generated content and intellectual property:

  • User Ownership: You retain ownership rights to AI-generated images and videos created with your inputs.
  • Input Requirements: You must own or have permission to use all uploaded images.
  • AI Model Rights: We do not claim ownership of AI models or training data.
  • Usage License: You grant us a license to process your images for AI generation purposes only.
  • No Training Use: Your images will not be used to train or improve AI models.
  • Third-Party Rights: Generated content must not violate third-party rights or likeness.

7. Subscriptions and Credits

KlipCam offers both credit-based purchases and auto-renewing subscriptions.

Credits:

  • Each AI generation consumes credits.
  • Credits can be purchased in packs.
  • Credit Expiration:
    • Subscription Credits: Credits granted via monthly subscription expire at the end of the billing cycle (1 month).
    • Rollover Policy: Unused subscription credits may roll over to the next month, up to a maximum of 1x your monthly allocation.
    • Bonus/Starter Credits: Free starter or bonus credits expire 1 year from the date they were granted.
    • Refunds/Adjustments: Credits granted as refunds or adjustments expire after 3 months.
  • Usage Order: Credits are automatically deducted from the batch that expires soonest (First-In, First-Out).
  • Credits may be lost if the app is deleted without an account backup.
  • All credit purchases are final and non-refundable.

Subscriptions:

  • KlipCam offers auto-renewing subscriptions (e.g., "Creator", "Pro") that provide monthly credits and premium features.
  • Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
  • Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Account Charged: Account will be charged for renewal within 24 hours prior to the end of the current period.
  • Management: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
  • Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Billing:

  • All purchases are processed by Apple according to their terms and conditions.

8. User Responsibilities and AI Ethics

You are responsible for all images you upload and AI content you generate. You agree to:

  • Lawful Use: Use AI features only for lawful purposes.
  • Image Rights: Only upload images you own or have permission to use.
  • Age Compliance: Not upload images of anyone under 18 years of age.
  • Consent: Obtain consent from people whose images you process.
  • Ethical Use: Use AI responsibly and not for deceptive purposes.
  • Content Appropriateness: Not attempt to generate inappropriate, harmful, or illegal content.
  • Disclosure: Clearly identify AI-generated content when sharing externally.

9. Data and Privacy

Your privacy is important to us:

  • Local Storage: Images and app data are stored primarily on your device.
  • Cloud Sync: If you enable Cloud Sync or sign in with Apple, data may be stored securely in the cloud.
  • Anonymous Usage: We use a random device identifier for analytics.
  • Temporary Processing: Images sent to AI services are automatically deleted after processing.

10. Disclaimers and Limitations

KlipCam is provided "as is" without warranties of any kind. MILIVON disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, MILIVON shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of your use of the app.

11. Third-Party AI Services

The app integrates with third-party services including Replicate (AI processing), Supabase (backend services), and Apple (payments). These services have their own terms and privacy policies that apply to their use.

12. App Updates and Changes

We may update the app from time to time to add features, fix bugs, or improve performance. Updates may be required for continued use. We reserve the right to modify or discontinue features with reasonable notice.

13. Termination

You may stop using the app at any time by deleting it from your device. We may restrict access to the app if you violate these terms. Upon termination, unused credits may be forfeited.

14. Changes to Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date. Continued use of the app after changes constitutes acceptance of the new terms.
